Using images, distinctive signs, logos and other intangible goods belonging to Came Cancelli Automatici S.p.A.

 

The user requests to use one or more of the images, signs, logos and other intangible goods – over which Came Cancelli Automatici S.p.A. has exlcusive rights of use – which hereinafter will be referred to as “CAME Images and Logos”. Only Images and Logos which can be downloaded in the Reserved Area of the Portal can be used.

The user requests to use CAME Images and Logos in compliance with the laws in force and especially with the legislation on the safeguarding of intellectual and industrial property (i.e. Legisl. D. n. 30/20/05 and subsequent amendments), and furthermore in compliance with the following free licence (“Free Use License"):

• The user acknowledges full and exclusive title to Came Cancelli Automatici s.p.a. of the usage rights for CAME Images and Logos;
• The User will be able to use the CAME pictures and logos free of charge.
• The user is allowed to use CAME Images and Logos only if, when accessing the Portal’s Reserved Area, any downloads and/or use of the Images and Logos, in any form whatsoever, is done while carrying out sales, installations or assistance operations of CAME Cancelli Automatici S.p.A. products, within the context of CAME’s sales and assistance network;
• The user undertakes to not patent or have patented in any country, whether directly or through any international or national, conventional means, any CAME Images and Logos or any other signs that may be mistaken for such;
• The user is allowed to use CAME Images and Logos exclusively to enter these into, said user’s website connected to the world wide web, and, onto any of said user’s means of advertising or publicity. In this case, the user shall comply with the indications given by CAME Cancelli Automatici S.p.A., as concerns the form, dimensions, colours and other graphic elements of CAME Images and Logos, without in any way, altering, adding, juxtaposing them in any way;
• Any violation, by the user, of one or more clauses of this Free Usage License shall result in immediate termination of the same, without prejudice to CAME’s right to seek any compensatory damages;
• CAME Cancelli Automatici S.p.A., may, in case and at its own discretion, notify the user, by email or fax about the termination of this Free Usage License, with prior notice of at least 10 (ten) days, barring any right of the user to seek any compensatory damages resulting thereof.
• Following the termination, for any reason whatsoever, of this Free Usage License, and/or of the business agreements with Came Cancelli Automatici S.p.A. or with one of operators belonging to CAME’s distribution or assistance network, the user, will no longer be allowed, effective immediately, to use any of CAME’s Images and Logos in websites or advertising and publicity materials, or any other means, whether magnetic or paper-based, previously used by the user. And, said user shall have to, and bear the expenses, immediately see to removing and destroying said Images and Logos and any other material and documents in or on which said Images and Logos may appear;
• The user shall have to reimburse CAME Cancelli Automatici S.p.A. for any damage resulting from violations to what is set forth in this Free Usage License.
